Welcome to AdStar.Ai. These Terms of Use ("Terms") govern your access to and use of the AdStar.Ai platform, including all related tools, services, and features (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement. By using the Service, you represent that you meet these requirements. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Registration

To use certain features, you must create an account. You can register using Google authentication, Microsoft authentication, or an email address and password. After registration, you may also add a passkey for passwordless sign-in. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

3. Use of the Service

AdStar.Ai provides AI-powered advertising creative generation tools. You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

Use the Service to create misleading, deceptive, or fraudulent advertising content.
Upload content that infringes on intellectual property rights of any third party.
Attempt to reverse-engineer, decompile, or extract the underlying AI models or algorithms.
Use automated bots, scrapers, or similar tools to access the Service.
Interfere with or disrupt the integrity or performance of the Service.
Use the Service to generate content that is illegal, harmful, hateful, or violates applicable advertising standards.

4. AI-Generated Content

The Service uses artificial intelligence to analyze web pages and generate advertising creatives. AI-generated content is provided "as is" and may not always be accurate, appropriate, or suitable for your needs. You are solely responsible for reviewing, editing, and approving all generated content before use. AdStar.Ai does not guarantee the accuracy, completeness, or suitability of any AI-generated output.

5. Intellectual Property

Your Content: You retain ownership of all content you upload to the Service, including brand assets, logos, product images, and text. By uploading content, you grant AdStar.Ai a non-exclusive, worldwide license to use, process, and store your content solely for the purpose of providing the Service.

Generated Content: Subject to your compliance with these Terms, you own the advertising creatives generated through the Service using your input content. AdStar.Ai retains no ownership rights over generated creatives.

Platform IP: The Service, including its design, features, AI models, and underlying technology, is the exclusive property of AdStar.Ai and is protected by applicable intellectual property laws.

6. Credits and Payment

Certain features of the Service require credits. Credits are consumed when generating advertising creatives. Credit packages and pricing are displayed on the platform. All purchases are final and non-refundable, except where required by applicable law. AdStar.Ai reserves the right to modify pricing and credit allocations at any time with reasonable notice.

7. Third-Party Services

The Service may integrate with or rely on third-party services (e.g., OpenAI for AI processing, Azure for hosting). AdStar.Ai is not responsible for the availability, accuracy, or practices of third-party providers. Your use of third-party services is subject to their respective terms and policies.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. ADSTAR.AI DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADSTAR.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO ADSTAR.AI IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) shall survive.

11. Changes to Terms

AdStar.Ai reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the platform. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
